If you have consented to data processing, we process your personal data on the basis of Art. 6 (1) (a) GDPR or Art. 9 (2) (a) GDPR, insofar as special categories of data pursuant to Art. 9 (1) GDPR are processed. In the case of explicit consent to the transfer of personal data to third countries, data processing is also carried out on the basis of Art. 49 (1) (a) GDPR. Furthermore, we process your data where it is required to fulfil a legal obligation, on the basis of Art. 6 (1) (c) GDPR.

Data processing may also be carried out on the basis of our legitimate interest pursuant to Art. 6 (1) (f) GDPR. You will be informed about the specific legal bases relevant in each case in the following paragraphs of this privacy policy.

Recipients of personal data

In the course of our business activities, we work with various external parties. In some cases, this also requires the transfer of personal data to these external parties.

We only pass on personal data to external parties if this is required within the scope of fulfilling a contract, if we are legally obliged to do so (e.g. passing on data to tax authorities), if we have a legitimate interest pursuant to Art. 6 (1) (f) GDPR in passing on the data, or if some other legal basis permits the data transfer. When using processors, we only pass on personal data of our customers on the basis of a valid data processing agreement. In the case of joint processing, a joint processing agreement is concluded.

Revocation of your consent to data processing

Many data processing operations are only possible with your express consent. You can revoke consent you have already given at any time. The legality of the data processing carried out until the revocation remains unaffected by the revocation.

Right to object to data collection in special cases and to direct advertising (Art. 21 GDPR)

IF DATA PROCESSING IS CARRIED OUT ON THE BASIS OF ART. 6 (1) (E) OR (F) GDPR, YOU HAVE THE RIGHT AT ANY TIME TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA FOR REASONS ARISING FROM YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR AFFECTED PERSONAL DATA UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR THE PROCESSING SERVES TO ASSERT, EXERCISE OR DEFEND LEGAL CLAIMS (OBJECTION PURSUANT TO ART. 21 (1) GDPR).

IF YOUR PERSONAL DATA IS PROCESSED FOR THE PURPOSE OF DIRECT ADVERTISING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH ADVERTISING; THIS ALSO APPLIES TO PROFILING INSOFAR AS IT IS ASSOCIATED WITH SUCH DIRECT ADVERTISING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR THE PURPOSE OF DIRECT ADVERTISING (OBJECTION PURSUANT TO ART. 21 (2) GDPR).

Right to lodge a complaint with the competent supervisory authority

In the event of breaches of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the member state of their habitual residence, place of work or the place of the alleged breach. This right to lodge a complaint is without prejudice to any other administrative or judicial remedy.

Right to data portability

You have the right to have data that we process automatically on the basis of your consent or in the performance of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done insofar as it is technically feasible.

Information, correction and deletion

Within the framework of the applicable statutory provisions, you have the right at any time to free information about your stored personal data, its origin and recipients and the purpose of the data processing and, if applicable, a right to correction or deletion of this data. You can contact us at any time regarding this and any other questions on the subject of personal data.

Right to restriction of processing

You have the right to request the restriction of the processing of your personal data. You can contact us at any time to do so. The right to restriction of processing exists in the following cases:

  • If you dispute the accuracy of your personal data stored by us, we generally need time to check this. For the duration of the check, you have the right to request the restriction of the processing of your personal data.
  • If the processing of your personal data was/is unlawful, you can request the restriction of data processing instead of deletion.
  • If we no longer need your personal data but you need it to exercise, defend or assert legal claims, you have the right to request the restriction of the processing of your personal data instead of deletion.
  • If you have lodged an objection pursuant to Art. 21 (1) GDPR, a balance must be struck between your interests and ours. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, this data may — apart from being stored — only be processed with your consent or to assert, exercise or defend legal claims or to protect the rights of another natural or legal person or for reasons of important public interest of the European Union or a member state.

SSL / TLS encryption

For security reasons and to protect the transmission of confidential content, such as orders or enquiries that you send to us as the site operator, this site uses SSL or TLS encryption. You can recognise an encrypted connection by the fact that the browser's address line changes from "http://" to "https://" and by the lock symbol in your browser line.

If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

Data collection on this website

Server log files

The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

  • browser type and browser version
  • operating system used
  • referrer URL
  • host name of the accessing computer
  • time of the server request
  • IP address

This data is not merged with other data sources. This data is collected on the basis of Art. 6 (1) (f) GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimisation of its website — for this, the server log files must be collected.

Contact form

If you send us enquiries via the contact form, your details from the enquiry form, including the contact data you provide there, will be stored by us for the purpose of processing the enquiry and in case of follow-up questions. We do not pass on this data without your consent.

The processing of this data is carried out on the basis of Art. 6 (1) (b) GDPR, insofar as your enquiry is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, processing is based on our legitimate interest in the effective handling of the enquiries addressed to us (Art. 6 (1) (f) GDPR) or on your consent (Art. 6 (1) (a) GDPR) where this has been requested; consent can be revoked at any time.

The data you enter in the contact form will remain with us until you request deletion, revoke your consent to storage or the purpose for data storage no longer applies (e.g. after your enquiry has been dealt with). Mandatory statutory provisions — in particular retention periods — remain unaffected.

Enquiry by email, phone or fax

If you contact us by email, phone or fax, your enquiry including all resulting personal data (name, enquiry) will be stored and processed by us for the purpose of handling your request.

The data you send us via contact requests will remain with us until you request deletion, revoke your consent to storage or the purpose for data storage no longer applies (e.g. after your request has been dealt with). Mandatory statutory provisions — in particular statutory retention periods — remain unaffected.

View counter

The blog articles on this website show how often the respective article has been viewed. When an article is accessed, your browser transmits the article's identifier to an interface at marlon-koenig.com/api. This is our own service; the data is not passed on to third parties.

As with every server request, your IP address is also transmitted for technical reasons. It is used exclusively to distinguish repeat views and is not permanently stored in plain text. No cookies are set, no cross-site tracking takes place and no profiles are created.

The legal basis is Art. 6 (1) (f) GDPR. We have a legitimate interest in being able to understand the reach of our content in a simple, data-minimising form.

Comment function (giscus / GitHub)

For the comments below the blog articles we use giscus. giscus embeds the comments via GitHub's discussion feature. The provider is GitHub B.V., Vijzelstraat 68-72, 1017 HL Amsterdam, Netherlands (parent company: GitHub Inc., 88 Colin P Kelly Jr Street, San Francisco, CA 94107, USA).

The comments are not loaded automatically. When you access an article, no script from giscus.app or GitHub is loaded and no connection to these services is established at first. Only when you actively click the "Load comments" button is a script from giscus.app and an embedded frame from GitHub loaded. In doing so, your IP address is transmitted to giscus.app and GitHub. Your click constitutes consent pursuant to Art. 6 (1) (a) GDPR and § 25 (1) TDDDG; it can be revoked at any time with effect for the future by not loading the comments. A transfer to the USA cannot be ruled out; GitHub is certified under the EU-US Data Privacy Framework.

To write a comment, you must log in with a GitHub account. GitHub's privacy provisions then additionally apply. Please note: comments are stored as a GitHub discussion in a publicly accessible repository and are therefore visible to anyone on the internet. Please do not publish any personal or confidential information there.

Further information: GitHub privacy statement

The legal basis is Art. 6 (1) (f) GDPR. We have a legitimate interest in an uncomplicated exchange with our readers. Where corresponding consent has been requested, processing is carried out exclusively on the basis of Art. 6 (1) (a) GDPR and § 25 (1) TDDDG; consent can be revoked at any time.
